Agreement to Terms

By installing and using Localify ("the App"), you agree to be bound by these Terms & Conditions. If you do not agree, do not install or use the App.

Service Description

Localify is a Shopify app that:

• Tracks customer behavior on your Shopify store
• Detects Shopify Markets localization data (locale, language, country, currency)
• Forwards events to your Klaviyo account via server-side API
• Enriches Klaviyo customer profiles with market data

Your Responsibilities

As a merchant using Localify, you agree to:

• Provide a valid Klaviyo Private API key
• Ensure you have permission to send customer data to Klaviyo
• Comply with GDPR, CCPA, and other privacy regulations
• Inform customers about data collection in your privacy policy
• Not use the App for fraudulent or illegal purposes

Our Responsibilities

We will:

• Provide the App functionality as described
• Maintain reasonable uptime (target: 99.9%)
• Protect your data with industry-standard security
• Process data in compliance with GDPR and privacy laws
• Provide customer support via email

Pricing & Payment

Localify is currently free to install. If we introduce paid plans in the future, existing users will be notified at least 30 days in advance.

You are responsible for any costs associated with Klaviyo (their pricing applies separately).

Data Ownership

You retain ownership of all customer data. Localify acts as a data processor on your behalf. Customer data is forwarded to your Klaviyo account and not stored permanently by us.

Limitation of Liability

Localify is provided "as is" without warranties. We are not liable for:

• Lost revenue or business opportunities
• Data loss (backup your Klaviyo account)
• Service interruptions or downtime
• Issues caused by third-party services (Shopify, Klaviyo, GCP)

Our total liability is limited to the amount you paid us in the past 12 months (currently $0).

Termination

You may terminate this agreement at any time by uninstalling the App from your Shopify store. We reserve the right to suspend or terminate accounts that violate these terms.

Upon termination, your data will be deleted within 48 hours (per Shopify's GDPR requirements).

Changes to Terms

We may update these terms occasionally. Significant changes will be communicated via email. Continued use of the App after changes constitutes acceptance.

Governing Law

These terms are governed by the laws of the Netherlands. Any disputes will be resolved in Dutch courts.
